Terms and Condition 

1. Agreement

By booking any session or service with us, you (the Client) agree to these Terms of Service. This agreement is binding upon booking confirmation and payment of a deposit or full session fee.

2. Booking & Confirmation

A session is not confirmed until:

  • A signed agreement or written confirmation has been received

  • A non-refundable retainer (deposit) has been paid

 

Dates and times are held exclusively for the Client only after both conditions above are met. We reserve the right to accept other bookings until confirmation is complete.

3. Session Conduct

The Client agrees to:

  • Arrive on time. Late arrivals may reduce session time without a reduction in fees.

  • Ensure all participants are prepared and briefed on session expectations.

  • Treat the photographer/videographer and any crew with respect. We reserve the right to terminate a session due to unsafe, hostile, or abusive conduct without refund.

  • Obtain necessary permits or permissions for any private or restricted venues.

4. Deliverables & Turnaround

Deliverables vary by service as outlined at the time of booking. All turnaround times are estimates and begin from the date of the session. We are not liable for delays caused by circumstances beyond our control.

Final images and films are delivered digitally via a private online gallery or download link. Physical prints, USB drives, or other formats may be arranged at an additional cost.

5. Image Selection & Editing

We reserve the right to select which images or footage are delivered as final edits. Not all images captured during a session will be provided. Requests for unedited or raw files are not fulfilled under any circumstances.

Clients may request minor revisions (e.g., color tone preferences) within 14 days of gallery delivery. Significant re-edits or additional editing beyond the agreed scope may be subject to additional fees.

6. Intellectual Property & Usage

The photographer/videographer retains full copyright of all images and footage produced. Clients are granted a personal, non-exclusive license for:

  • Personal use (printing, sharing on personal social media, gifting)

  • Business or commercial use only if explicitly agreed upon in writing before the session

We reserve the right to use any images or footage in our portfolio, website, social media, and marketing materials unless the Client requests otherwise in writing before the session date.

7. Third-Party Vendors

We are not responsible for the actions or quality of work provided by other vendors (venues, makeup artists, coordinators, etc.). We will make every effort to cooperate with other vendors in good faith.

8. Force Majeure

In the event of circumstances beyond our reasonable control (such as natural disasters, severe illness, death in the family, or public emergencies), we will make every effort to reschedule the session. If rescheduling is not possible, a pro-rated refund may be issued at our discretion.

9. Liability

Our liability is limited to the total amount paid for the session. We are not responsible for indirect, incidental, or consequential damages. In the unlikely event that all deliverables are lost due to equipment failure or unforeseen technical issues, our liability is limited to a full refund of the session fee.

10. Governing Law

These terms are governed by the laws of the jurisdiction in which the photographer/videographer operates. Any disputes shall be resolved through good-faith negotiation before pursuing legal action.
